Terms & Conditions relating to the sale of cards
Welcome to www.maltapass.com.mt, a website which is owned and run by Malta Pass Limited (“MPL”), a company registered in Malta.
This document is divided into two parts:
Part 1, which regulates the sale of cards from www.maltapass.com.mt (the “Website”). You should read this part if you intend buying a card from our Website;
Part 2, which provides terms and conditions which apply to users of all cards, whether bought from the Website or from a physical location. You should read this part if you have bought a card from our Website or from a sales outlet selling our cards.
In these terms and conditions, “Cards” means Malta Pass Cards which grant holders access to attractions/tours in Malta and Gozo.
PART 1 – SALE OF CARDS THROUGH THE WEBSITE
1. Our contract
When you place an order to purchase a Card from MPL, we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a Card or Cards which is accepted by us when we send e-mail confirmation to you confirming the sale of the Card or Cards (the " Confirmation E-mail"). That acceptance will be complete at the time we send the Confirmation E-mail to you.
If you wish, we can arrange for delivery to an address provided for this purpose. While we do our utmost to ensure the Card will arrive in the shortest possible time, MPL cannot be held responsible for any delays in the postal service. The Malta Pass does not guarantee shipping and does not accept any liability. Mislaid or missing orders may only be reissued with additional payment.
2. The Malta Pass Guide
With each order made by you, we will send you a Malta Pass Guide. This guide contains information about the attractions/tours to which the Card gives you access. Please note, however, that whilst we make reasonable efforts to ensure that the Malta Pass Guide is up to date, printing restrictions mean that there may be additional attractions/tours to which your Card gives you access which are not listed on the Guide or there may be attractions/tours listed on the Guide to which the Card no longer gives you access. Accordingly, you should visit our Website to view the complete and updated list of attractions/tours to which the Card gives you access.
3. Refunds and Cancellation of Purchase
Since the Card relates to the provision of access to leisure services which we undertake to provide, through our service providers, within a specific period of 365 days, cancellation of this contract is not allowable. MPL does not offer refunds.
4. Children
MPL does not sell Cards for purchase by children. If you are under 18, you may use our Website only with the involvement of a parent or guardian.
5. Electronic communications
When you visit our Website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
6. Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to the Website, any policies, and these Conditions of Sale at any time. You will be subject to the policies and Conditions of Conditions of Sale in force at the time that you use the Website or that you purchase Cards from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
7. Language
The language of this agreement is English.

PART 2 – TERMS AND CONDITIONS APPLICABLE TO USE OF ALL CARDS
1. Card Validity
All Cards are valid 365 days from date of purchase. The Card becomes active from the moment it is first used and is then valid for 24 hours, 48 hours or 72 hours, depending on the type of card purchased.
2. Access to Site Attractions/Tours
Card holders can visit each attraction/tour only once with the Card. The Malta Pass Guide contains information about the attractions/tours to which the Card gives you access. Please note, however, that whilst we make reasonable efforts to ensure that the Malta Pass Guide is up to date, printing restrictions mean that there may additional attractions/tours to which your Card gives you access which are not listed on the Guide or there may be attractions/tours listed on the Guide to which the Card no longer gives you access. Accordingly, you should visit our Website to view the complete and updated list of attractions/tours to which the Card gives you access.
3. Non-Transferable and Non-Refundable
All Cards purchased are non-transferable and non-refundable. There will be no refunds or replacements for lost or stolen cards.
4. Attraction/Tour Operators
All participants listed on this website are contractually bound with MPL to offer free entry to Card holders. We have taken all reasonable care to ensure that only properly run and reputable facilities of good standing are within the Malta Pass scheme. However, we will not be liable for any deficiencies in service, quality of merchandise or health and safety pertaining to any particular facility. All complaints or claims must be made directly to the facility concerned.
You should also note that access to certain facilities is subject to terms and conditions imposed by the facility owner. You must comply with these terms and conditions to obtain access to the facility.
5. Opening Times and Days
Opening times of attractions/tours will fluctuate from time to time and therefore it is recommended that you check with the attraction/tour concerned prior to visiting it to ascertain the current position.
You should also note that some attractions/tour may be subject to temporary closure due to unforeseen circumstances. No refunds can be given in the event of any such temporary closure.
6. Pricing, Payment, Availability and Liability
We list availability information for services sold by us on the Website. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability.
All prices are inclusive of VAT. Payments are to be made in Euro, and by means of one of the following credit Cards: [BOV Cashlink, VISA, or Mastercard].
All prices are correct at the time of publication.
Whilst we take every care in choosing our service providers, inclusion of an attraction/tour in our range does not mean that we guarantee the safety standards or satisfactory performance of any of these service providers. MPL’s liability for any claim of breach of obligation shall not exceed the price the Card. All these terms and conditions apply as a condition of using any Card. These terms and conditions do not affect your statutory rights as a consumer. We do not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or willful misconduct.
7. Acceptance
When you purchase a Card you are accepting these terms and conditions.
8. Events beyond our reasonable control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
9. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
10. Governing law and jurisdiction
These conditions are governed by and construed in accordance with the laws of Malta and applicable regulations and directives of the European Union. You agree, as we do, to submit to the non-exclusive jurisdiction of the courts of Malta.

Cookies - A cookie is an alphanumeric identifier which we transfer to your hard drive through your web browser when you visit our website. It enables our own system to recognise you when you visit our Website again and improve our service to you. Cookies may also be used to compile aggregate information about areas of our Website that are visited most frequently. This traffic information can be used to enhance the content of our website and make your use of it easier. We do not track which pages you looked at while visiting our Website. If you wish to reject our cookie, you can configure your browser to do so.
Your Rights - As an individual you may exercise your right to access the data held about you by us by submitting your request in writing to the data controller. Although all reasonable efforts will be made to keep your information updated, you are requested to inform us of any change to your personal data. In any case if you consider that certain information about you is inaccurate, you may request rectification of such data. You also have the right to request the blocking or erasure of data which has been processed unlawfully.

We will attempt to limit the frequency and duration of any such suspension or restriction.

MPL grants you a limited licence to access and make personal use of the Website, but not to download (other than page caching) or modify it, or any portion of it, except with express written consent of MPL. This licence does not permit any resale or commercial use of this Website or its contents; any collection and use of any service listings, descriptions, or prices; any derivative use of this Website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
This Website or any portion of this Website may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent.

You may not use any meta tags or any other "hidden text", MPL’s names or trademarks without the express written consent of MPL. You understand that you, and not MPL, are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.

All content included on the Website, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of MPL, its affiliates or its content suppliers and is protected by Maltese and international copyright, authors' rights and database right laws.
6. Trademarks
Malta Pass and other marks indicated on our Website are trademarks or registered trademarks of MPL or its affiliates. MPL’s trademarks and trade dress may not be used in connection with any product or service that is not MPL’s, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits MPL. All other trademarks not owned by MPL that appear on this website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by MPL.
7. Accuracy and Links
We make all reasonable efforts to ensure that the information published on this Website is accurate. The information is updated regularly, MPL does not warrant or assume any legal liability for the accuracy of any information disclosed and accepts no responsibility for any errors or omissions.
We may from time to time place links on our Website. We are not responsible for the contents of any off site pages or links referenced. The presence of a hyper-link from a page does not imply any kind of endorsement of the content of these pages or links by MPL.
8. Liability and Indemnity
You accept the Website "AS IS" with any faults or failings and without any representation, warranty or guarantee whatsoever, express or implied, including without limitation any implied warranty of accuracy, completeness, quality, merchantability, fitness for a particular purpose or non-infringement.
In no event (except as otherwise specified in these terms and conditions) will MPL be liable for any injury, loss, claim, damages or any special, incidental, consequential, exemplary or punitive damages of any kind arising out of or in connection with your use of the Website, whether based in contract, tort and whether negligent or otherwise, even if we have been advised of the possibility of such damages. In the event that this exclusion of liability is held by a court of competent jurisdiction to be unlawful, but that liability may be lawfully limited, our aggregate total liability to you for all such damages and losses shall be limited to Euro 100.
You agree to indemnify us and keep us indemnified as well as our successors and assigns, and our directors, officers, employees and agents (collectively the "Website Owner") from and against any and all liability, damages, losses, claims (including reasonable legal fees) resulting in any way from your use of the Website and the Material.
